A
good dimension for a nation’s development is in
the number of patents internationally granted. The fact
that Brazil occupies the 27th position in the ranking
of patents can be a very preoccupying point. It can
be a consequence of the distance between the academic
scientific production and researches and development
of the industry. This is one of the subjects that will
be discussed on this new edition of Cruzeiro/Newmarc
Intellectual Property newsletter.
Read about
the project of the National Center of Biological Material
that will be responsible for receiving the filing of
living material of Brazilian biotechnological patents.
It is becoming a reality. The good news is that Brazil
will accept filing applications of microorganisms of
biotechnology patents.
New challenges
for Industrial Property Agents facing the beginning
of on line system operations for trademarks and patents
applications in Brazil. Read about the importance of
specialized performance by Industrial Property Agents.
And more:
be informed of what the Law of the Industrial Property
states about the use of names of places in the identification
of products and services, in an article by the lawyer
Anali Anhuci on "Geographical Indications."
The protection
to forensic petitions, objecting authorial copyright,
is another article of our newsletter, written by the
lawyer Andréia Fátima Bartolo de Carvalho
Tozetto.
And finally,
just to relax, read about Ridicule Patents, an article
recently published in the "The New York Times".
Do not miss the adventures of Regus Patoff, this time,
claiming his rights.

Brazil
will accept applications for biotechnology Patents
The
National Center of Biological Material, that will be responsible
for receiving the filing of living material for Brazilian
biotechnological patents, is becoming a reality. The National
Institute of Intellectual Property (INPI) settled an accord
with National Institute of Metrology, Normalization and Industrial
Quality (Inmetro), in the beginning of April, for the accomplishment
of the project. The partnership is advanced.
New challenges for industrial property
agents
The beginning of on line
system operations for trademarks and patents applications
in Brazil reinforce the importance of specialized performance
by Industrial Property Agents.
Published
in "The New York Times" in March 22, 2006.
Something
has gone very wrong with the United States patent system.Americans
think of the granting of patents as a benevolent process that
lets inventors enjoy the fruits of their hard work and innovations.
But times have changed.

this year, Newton Silveira, Cruzeiro/Newmarc lawyer and partner-director,
pronounced lecture on the subject: “Immaterial Elements
of Commercial Establishment" at EPM - Sao Paulo School

Geographical
Indications
By Anali
Anhuci
Besides classifying
the geographical indications, the Industrial Property Law
foresees that its use is restricted to the producers and local
established rendering of services, considering the denominations
of origin. Quality requirement fulfillment is demanded. As
the attractive power exerted by the denomination of origin
is, in fact, very strong, this is the reason why only those,
who offer products and services of superior standard, must
usufruct of this true certification of quality.
